This should alarm all content creators, especially those creating visual or audio arts. Fox News is arguing that copyright shouldn't matter when they share content on social media because social media is inherently transformative, thus circumventing copyright laws.

If Fox wins, it means any entity out there, from for-profit to non-profit corporations and media outlets, can use your content free of charge as long as they share it on social media.

This must be those market forces Fox is always saying they're behind.

I agree with Fox News on this.

Courts have already decided numerous times on this very issue before. Internet forums, of which Facebook is one, can present copyrighted works because the purpose is not to publish the work itself, but to create a layer of interaction around it. This falls under "fair use".

It would be like you bringing a Miley Cyrus CD into church, playing one of its songs to a live audience, for the purpose of creating discussion about it's decency. Fair use prevents the recording industry from suing you for unauthorized public performance.

But that doesn't stop copyright owners from suing. Most publishers and Internet forums comply with requests to remove content because it's easier and cheaper to do so. And even though courts have already ruled on this, the threat of lawsuits continue. I'm actually glad to see Fox News use its muscle in this case.

I'm also shaking my head at IBT for even trying to spin this piece of news. They're clearly capitalizing on liberal hated of Fox for social media shares.

Fox News is a for profit company. They're mission in life is to make money for the CEO and shareholders. There is a difference between fair use and used to gain profit.
