Not to mention firing your weapon in public without being in the act of defending self or others is illegal. So is using the gun to scare or intimidate people, to which I believe this applies. His intent was to scare the thief into surrendering.

As he should be. I'm not a against guns or people's right to carry them, but the notion of a "good guy with a gun" is a right wing masturbatory fantasy. Handguns are designed for personal defense. At the point the thief was running away he was no threat to no one. Even if he was in the middle of a robbery (sans a gun of his own) he was no threat to anyone's person. Under no circumstance was this "good Samaritan" in the right, here.
