The CREATION of RACISM belongs to Governments. That Little girl belongs with a loving family, not being taken away from one because of her DNA. May God curse the government officials that involved themselves in this madness.

For me, that would go back to around 1790, if I'm counting on my fingers correctly, to find the relative. So for this child, 1830s or so...

Regarding custody - whether you're talking about "parental rights" "rights of grandparents" (or other relatives) or whether she is 1/64 Native American or 100%, the overriding concern should be for what is in the best interest of the child. This is not in the best interest of this child. Children are not property.

Foster parents are not the same a adopted parents. Foster parent are suppose to be temporary until either the child can be returned to the biological parents or another permanent family. Why would somebody want any child to stay in the Foster Parent system? Get the child to a permanent home as soon as possible.

The articles on this subject tell us they've been trying to adopt her for a long time; that is why this has come up. The people she was just given to are related to her original family only through marriage, and this happened because she is 1/64 Choctaw, which is roughly 1.5% of her DNA. To paraphrase.
