Ruling Backs Palin’s Use of Private E-Mail for State Work - NYTimes.com

With the above ruling and previously with Colorado's courts deciding that use of private cell phones to conduct public business, it is perfectly legal without the ability for news organizations or FOIA to conduct public business on private technology without a venue for checks and balances. So, all we have to do is let all public figures get Gmail, Yahoo or AIM accounts for personal use, let them conduct business in direct relation to their elected office and the people have no recourse to know who, when or how long these conversations are taking place, nor the content of the conversations! Long live open government! Long live judges that do not believe in checks and balances or the rights of the people to know what their elected officials are doing!
